Our operations are under ViralPe Sales and Services Private Limited, with our mobile apps branded as ViralPe, which drives sales for online post-sales aggregators, e-commerce platforms, and offline brands with which we are partnered.
• "User Information" refers to both Personal Information and Sensitive Personal Data or Information.
• "Website" refers to https://viralpe.com, and the subdomains or other pages in the sites and the "Application" or "App" refers to the ViralPe mobile application available on the Android Play Store or iOS App Store. Collectively, they are referred to as the "Platform" or "Platforms".

The User unequivocally agrees that this Privacy Policy, along with the Terms and Conditions, constitutes a legally binding agreement between the User and ViralPe. The User further acknowledges that they will be subject to the rules, guidelines, policies, terms, and conditions applicable to any service provided by ViralPe, including the Services. These terms will be deemed incorporated into the broader Terms and Conditions and treated as part of the same agreement.

 

This document is an electronic record pursuant to the Information Technology Act, 2000, and the associated rules, including those governing electronic records as amended by the Information Technology Act, 2000. The terms "Party" and "Parties" shall refer to the User and ViralPe individually and collectively, depending on the context.

The Parties expressly agree that, subject to the relevant provisions of this Policy, ViralPe sales and Services Pvt Ltd reserves the right to amend or modify this Privacy Policy and the Terms and Conditions at any time, without prior permission or notification to the User, in accordance with the best practices and laws set by the State or Central Government of India. Any such amendments or modifications will take effect immediately upon publication. The User is responsible for periodically reviewing the Policy and Terms and Conditions to stay informed of any updates. By continuing to use the Services after changes are made, the User is deemed to have consented to these modifications.

 

Our website and applications offer diverse interaction options, including to socialise with friends and others to buy different products through wide range of vendors, to sell your products and exhibit it among large user base e-commerce, and content creation. To enhance your experience, we may request personally identifiable information. This data enables tailored search results, facilitated connections, and optimized services. As long as the User complies with the Policy and Terms and Conditions, they are granted a personal, non-exclusive, non-transferable, revocable, and limited privilege to access and use the Services.

• We may send you relevant commercial or marketing messages, but you can opt out of these at any time by unsubscribing. No marketing emails will be sent once you have unsubscribed.

The User expressly agrees and acknowledges:

1. Public Domain Information:

Information that is publicly available or accessible under the Right to Information Act, 2005, or any other applicable law will not be classified as ‘Personal Information’ or ‘Sensitive Personal Data or Information’ for the purposes of this Policy.

2. Automatic Data Collection:

App/platform may automatically track certain information about the User based on the User’s IP address and behaviour on the Platform, and the User expressly consents to this collection. This data may include the User’s computer and browser information, IP address, and mobile device details. Such data may be used for internal research on user demographics, interests, and behaviour to better understand User preferences. This data may be shared with third parties to facilitate the provision of Services, and the User consents to this sharing. Additionally, anonymized, non-personally identifiable data may be shared with third parties for market research or feature development.

3. Correspondence Collection:

 Any and all information related to the User, collected by Apps, including personal correspondence such as emails, SMS, WhatsApp notifications, or calls, may be compiled into a file or folder specifically allocated to the User, and the User consents to this.

4. Communication with User:

To keep the User informed about activities on the Website, ViralPe may send emails, SMS, WhatsApp notifications, app notifications, and other marketing communications. These communications include transaction messages, referral earnings updates, payment confirmations, and important administrative messages. These communications are not shared with anyone else apart from the User.

5. Marketing Communications:

Apps may also send newsletters, WhatsApp notifications, SMS, app notifications, browser notifications, and marketing campaigns. The User may opt-out of such marketing communications by contacting ViralPe.

6. Anti-Spamming Policy:

ViralPe explicitly prohibits spamming by its members and takes action against reported incidents of spamming. Users are encouraged to report any spamming incidents for investigation.

7. Promotional Offers:

The contact information provided by the User may be used to send promotional offers, whether based on previous interests or otherwise. The User consents to receive such communications but may unsubscribe at any time by using the unsubscribe link or contacting ViralPe.

8. Optional Surveys:

ViralPe apps may request the User to complete optional surveys to collect contact and demographic information, which will be used to improve Services and provide Users with relevant offerings.

ViralPe may maintain records of electronic communications and phone calls for administrative, support, research, and development purposes.

10. User Reviews:

ViralPe may request Users to write reviews of services availed on the Platform. The User consents to the publication of such reviews, along with their name and contact details, to benefit other potential Users.

ViralPe reserves the right to remove any content, review, survey, or feedback submitted by the User at its discretion without notification.

• Sensitive Personal Data:

The generation and collection of Sensitive Personal Data or Information as per the Information Technology Act, 2000, requires the User’s express consent. By agreeing to this Policy and clicking the "I agree" button, the User consents to the collection of such data under applicable laws.

13. Accuracy of Information:

The User is responsible for ensuring the accuracy of the information submitted. The User may correct or update inaccuracies by contacting ViralPe. ViralPe will update the records as soon as reasonably practicable. However, in some cases, ViralPe may not correct or delete Personal Data, such as in evaluative documents or prosecution-related records.

• Voluntary Submission:

All information provided to ViralPe is voluntary. Users have the right to withdraw consent at any time, although withdrawal is not retroactive. The User may request account deletion or request that their information no longer be used by contacting ViralPe.
